Romania becomes 18th UPC member

C&F: “Wider reach of the unitary patent and strong incentive for innovative companies in the EU”

Düsseldorf, May 24, 2024 – Romania has signed the Agreement on a Unified Patent Court (UPCA), making it the 18th contracting state for the new system, in which European patents apply with unitary effect.

Romania’s law 81/2024 on the ratification of the UPCA came into effect on April 14, 2024. According to the UPCA, this ratification will come into force on the first day of the fourth month following Romania’s deposit of its instrument of ratification. If Romania does this promptly, the country could officially become a contracting member of the Unified Patent Court (UPC) as early as fall 2024. Cohausz & Florack (C&F) sees this as good news: “We are delighted that the UPC is growing to include Romania, an important member of the EU and a strong economic partner,” says Gottfried Schüll, patent attorney and partner at C&F. “The unitary patent will now cover 19 million more people in the participating EU states. This is without a doubt a huge incentive for many companies operating throughout Europe.”
